NAGE Secures Major Court Victory Protecting Federal Workers' Rights

The National Association of Government Employees (NAGE), alongside a coalition of federal labor organizations, has won an important legal victory that protects the rights of federal employees and preserves a fair process for union representation.

On June 29, 2026, the U.S. District Court for the District of Massachusetts struck down an interim rule issued by the Federal Labor Relations Authority (FLRA). The rule would have shifted authority over federal representation cases including union elections, bargaining unit questions, and certification or decertification matters away from experienced FLRA Regional Directors and into the hands of the three-member FLRA Authority in Washington, D.C.

NAGE challenged the rule because it removed longstanding safeguards from a process that has protected federal employees for more than four decades. The court agreed, finding that the FLRA failed to follow the requirements of the Administrative Procedure Act when issuing the rule.

This decision preserves a fair and established process for handling representation cases and reinforces that federal agencies cannot make sweeping changes affecting employees' rights without following the law.
